PRIVACY POLICY

 

The privacy policy (hereinafter referred to as the "Privacy Policy") defines the rules for the processing of personal data and the use of cookies by STM Cyber Sp. z o. o. with its registered office in Warsaw, 02-092, ul. Żwirki i Wigury 16A, entered into the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw under KRS number 0000872288, NIP: 5272677191, (here in after referred to as: "Administrator") on the website www.stmcyber.pl (" Side").

 

In the Privacy Policy, we inform the Users of our Website about how we collect and use personal data, on what legal grounds we process personal data, and what rights Users have in connection with the processing of their personal data, in accordance with the Regulation of the European Parliament and of the Council (EU) 2016 /679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation; hereinafter referred to as "GDPR").

The privacy policy applies to the processing of the personal data of the following persons by the Administrator:

  • users of the Website who are natural persons for whom the Administrator provides electronic services;

  • representatives, employees, and associates of Website Users who are not natural persons;

  • persons contacting the Administrator or with whom the Administrator contacts, by phone, e-mail, or via another communication channel,

hereinafter "Users"

The following types of personal data may be collected, stored, and used:

  • information about your computer, including IP address, geographic location, type and version of web browser, and operating system;

  • the e-mail address provided when registering on the website or for contact;

  • information you enter when creating a profile on our site - for example, name, profile pictures, gender, date of birth, relationship status, interests and hobbies, education, and employment details;

  •  handling complaints and complaints regarding the operation of the Website;

  • ensuring the security of the Website and preventing fraud;

The administrator processes data on the following legal basis:

article 6 sec. 1 lit. an of the Regulation of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter "Regulation"), i.e. based on the user's consent, in situations where such consent was required and was given,

article 6 sec. 1 lit. b of the Regulation in order to perform contracts, consider complaints, or take action before concluding a contract, 

article 6 sec. 1 lit. c of the Regulation, in order to fulfill our legal obligations, in connection with issuing an invoice for the purchase of goods

 

article 6 sec. 1  lit. f  of the Regulation, when the basis for processing is the legitimate interest of the Administrator, in order to improve our offer, ensure the best quality of our goods and services and inform our customers about them, conduct direct marketing, protect or pursue claims, ensure accountability for our compliance with legal obligations.

 

The administrator processes the data for the following time:

Personal data processed on the basis of the Administrator's legitimate legal interest will be stored for the duration of this interest or until an objection is raised by the data subject.

Personal data processed on the basis of consent will be stored until its withdrawal.
The administrator does not store your data for periods longer than those resulting from applicable law.

 

Data Sharing

The administrator does not disclose data to third parties if there is no legal basis for doing so. The recipients of your personal data may also be entities authorized to receive your data - only in justified cases and on the basis of relevant legal provisions
In connection with the processing of your personal data, your personal data may be made available or entrusted to the following entities:

  • authorized employees of the Administrator,

  • entities providing outsourcing, accounting, IT services, and maintaining IT infrastructure for the Administrator,

  • entities related to the Administrator in the country and abroad,

  • public authorities on the basis of statutory requirements,

  • Administrator's partners

 

Personal data may be transferred to countries/international organizations outside the European Economic Area, when these countries/organizations, based on the decision of the European Commission, have been recognized as ensuring an adequate level of protection of personal data to the level of security applicable in the European Economic Area or provided that appropriate safeguards are applied, which may rely on the use of binding corporate rules, standard data protection clauses adopted by the European Commission, standard data protection clauses adopted by the President of the Office for Personal Data Protection or contractual clauses approved by the President of the Office for Personal Data Protection.

 

Data profiling: personal data of website users are not subject to profiling

 

Users of the Website have the following rights:

  • the right to access your data (Article 15 of the GDPR)

  • the right to request rectification of your data (Article 16 of the GDPR), when they are untrue or incomplete

  • the right to request the deletion of your data (Article 17 of the GDPR), when the data is not processed in accordance with the law, the consent to data processing is withdrawn or the data is no longer necessary for the purposes for which they were collected, an objection to data processing is raised, the data should be deleted in order to comply with a legal obligation,

  • not to be subject to automated decision-making, including profiling,

  • the right to request the restriction of data processing (Article 18 of the GDPR)

  • the right to transfer data (Article 20 of the GDPR), when processing is based on consent or a contract

  • the right to withdraw consent to the processing of personal data. Consent to the processing of personal data may be withdrawn at any time, without affecting the lawfulness of processing based on consent before its withdrawal. Consent can be withdrawn by sending an e-mail to the following address: [email protected]

  • the right to object to the processing of personal data when the processing of personal data is based on a legitimate interest or for statistical purposes and the objection is justified by the particular situation of the data subject or when the data is processed for direct marketing purposes

  • lodge a complaint regarding data processing to the President of the Office for Personal Data Protection.

 

The Website contains links to external websites of our partners that do not belong to the Administrator. Therefore, the Administrator is not responsible for the content on these websites.

We regularly review our Privacy Policy and make changes to it when it turns out to be necessary or desirable due to new laws, guidelines, and practices in the area of personal data protection. 

We also reserve the right to change our Privacy Policy in the event of changes in the technology we use to process personal data, as long as it affects the wording of this Policy, as well as in the event of a change in the methods, purposes and legal grounds for the processing of personal data by us.
